These Terms of Service ("Terms") constitute a legally binding agreement between Call Monkey LLC ("Company," "we," "us," or "our"), located at 5830 E 2nd St, Ste 7000 #31971, Casper, WY 82609, and you or the entity you represent ("User," "you," or "your"). By accessing or using the ByeByeWebDesigners.com website, platform, applications, or any related services (collectively, the "Services"), you agree to these Terms. If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.

We may revise these Terms periodically. We will post the updated version on our website. Your continued use of the Services after the effective date of any changes constitutes acceptance of the revised Terms. If you do not agree to the changes, you must discontinue use of the Services.

• Services: Our AI-powered website builder that generates websites, pages, designs, text, images, and other content based on your inputs; SEO reports that analyze and suggest improvements for search engine performance; and citation reports that track online mentions, listings, or references.
• User Data: Any information, prompts, content, files, business details, or materials you provide or upload to the Services.
• Generated Content: Any websites, pages, text, designs, images, reports, suggestions, or other outputs produced by the Services through AI or analysis tools.
• Account: Your registered user account for accessing the Services.

2. Eligibility and Accounts

You must be at least 18 years old and legally capable of entering into contracts. The Services are for business or professional use only. You agree to provide accurate, up-to-date information when registering and to maintain its accuracy. You are responsible for all activities under your Account, including those by your employees or agents. Keep your credentials confidential and promptly report any unauthorized use to Humans@ByeByeWebDesigners.com.

3. Description of Services

• AI Website Builder: An AI tool that creates draft websites, including layouts, content, images, and basic structure based on your descriptions or inputs. We may include placeholder elements (e.g., basic legal pages like Privacy Policy or Terms of Service) solely as starting points.
• SEO Reports: AI-generated analyses and recommendations regarding search engine optimization, keyword suggestions, on-page factors, and performance insights.
• Citation Reports: Tools that monitor and report on online citations, directory listings, reviews, or mentions relevant to your business.

The Services use artificial intelligence and automated processes. Outputs are generated based on patterns in training data and may contain inaccuracies, omissions, or inconsistencies. We may update, modify, suspend, or discontinue features at any time.

4. User Responsibilities

You bear full responsibility for:

• All User Data and Generated Content.
• Compliance with applicable laws, including intellectual property, data protection, advertising standards, accessibility (e.g., ADA/WCAG), and any industry-specific regulations.
• Conducting a complete, independent human review of all Generated Content before publishing, using, or relying on it. This includes verifying accuracy of text, images, designs, links, functionality, SEO suggestions, citation data, pricing, claims, and any placeholder legal documents. A qualified professional must confirm factual correctness, legal compliance, branding alignment, and suitability for your business. The Services provide tools and drafts only—not professional advice or guaranteed results.
• Ensuring Generated Content does not infringe third-party rights or contain misleading statements.
• Backing up your data; we are not liable for loss or corruption.
• Properly implementing any SEO or citation recommendations; results depend on many external factors beyond our control.

You agree not to:

• Use the Services unlawfully or to violate rights of others.
• Upload malicious code, spam, or prohibited content.
• Reverse engineer, scrape, or attempt to extract our models or proprietary technology.
• Rely on the Services for high-stakes decisions without verification (e.g., legal compliance, financial claims).
• Generate content that is defamatory, discriminatory, or harmful.

AI outputs can include errors, hallucinations, biases, or non-unique results. Always verify independently.

5. Intellectual Property

We (or our licensors) own the Services, underlying technology, trademarks, and proprietary materials. You retain ownership of your User Data. To the extent permitted by law and subject to these Terms, you own the Generated Content you create, though due to AI's nature, it may resemble outputs provided to others and may not qualify for full copyright protection in all jurisdictions.

You grant us a worldwide, non-exclusive, royalty-free license to use, process, store, and analyze User Data and Generated Content as necessary to deliver, maintain, improve, and secure the Services (including for model training in anonymized or aggregated form) and as required by law.

You represent that you have all rights necessary for your User Data and that neither it nor the Generated Content infringes third-party rights.

6. Payments and Billing

Fees are charged in advance per the selected plan (monthly, annual, etc.). Fees are non-refundable except as required by law or expressly stated. We may adjust pricing with notice; continued use after notice indicates acceptance. Late payments may incur interest at 1.5% per month or the legal maximum.

You are responsible for all applicable taxes (excluding taxes on our income).

7. Disclaimers

THE SERVICES AND ALL GENERATED CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE PERFORMANCE.

We make no guarantees regarding:

• The accuracy, relevance, or usefulness of AI-generated websites, SEO reports, or citation reports.
• Improvements in search rankings, traffic, conversions, or citation accuracy from using our reports.
• Error-free operation, security, or compatibility.

AI tools are experimental in many respects; outputs require human oversight and correction. We are not liable for reliance on any output.

8. Limitations of Liability

TO THE FULLEST EXTENT ALLOWED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR WEBSITE PERFORMANCE ISSUES, EVEN IF ADVISED OF THE POSSIBILITY.

Our total liability for any claim related to these Terms or the Services is limited to the fees you paid us in the twelve (12) months before the claim arose (or $100 if no fees paid). This applies regardless of theory of liability.

Exceptions: This limitation does not apply to our gross negligence, willful misconduct, or indemnification obligations.

9. Indemnification

You agree to defend, indemnify, and hold harmless us, our affiliates, officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Services.
• Your User Data or Generated Content.
• Breach of these Terms or violation of law.
• Any claim that your website, reports, or content infringes or violates third-party rights.
• Disputes related to SEO results, citation accuracy, or business outcomes.

10. Termination

You may cancel your subscription via your Account; it ends at the close of the current billing period. We may suspend or terminate access for breach, non-payment, or to protect the Services or others. Upon termination, cease use; we may delete your data after a reasonable period. Provisions on liability, indemnification, IP, and disclaimers survive.

11. Governing Law and Dispute Resolution

These Terms are governed by Wyoming law, without regard to conflicts principles. Disputes shall be resolved exclusively in state or federal courts in Natrona County, Wyoming. You consent to the personal jurisdiction of those courts.

12. Miscellaneous

• Entire Agreement: These Terms (with Privacy Policy) are the full agreement.
• Severability: Invalid provisions do not affect the rest.
• No Waiver: Failure to enforce does not waive rights.
• Independent Contractors: No partnership or agency created.
